With MM4, I could set the CD Rip to MP3 - 320 and it would stay that way.
With MM5, I have repeatedly had the issue where I plug in my external CDRW/DVD drive, pull up the info in MM5, then go to rip it and suddenly it's back to VBR - 192. It's incredibly frustrating, especially when I've ripped several disks only to find that they're 192 bps instead of the 320 I wanted.

did this clear up the FLAC issue as well? It always resets the Compression level to 6 after you close the program.

Yes, it could happen for any format in some situations, now it should be ok. You can test it with the last 5.0.2 beta version.
